ELEGANTE, GRANDE, MIRAGE WARRANTY

This limited warranty is intended to warrant to the initial purchaser but not to any third party, that a genuine Retractableawnings.com awning frame will remain in good and serviceable condition according to the following schedule:

Awning frame and parts are guaranteed by Retractableawnings.com against manufacturing defects for a period of twenty five (25) years from the initial date of purchase.

The warranty shall not be applicable and shall be of no force or effect in the event that:
 
  1. The system is not timely paid for in accordance with payment terms.
  2. The system or any part of it is damaged by any act of nature including but not limited to hurricanes, gales, tornadoes, wind, snow, sleet, hail, rain, flood, fire or any other similar or dissimilar condition, or by normal wear and tear.
  3. The system or any part of it is damaged by vandalism, improper use, improper installation, accumulation of weight or heavy loads on the awning or
  4. The system is damaged due to lack of cleaning or maintenance whether routine or otherwise.

Subject to adherence to the foregoing terms and conditions, if the framework is defective in material or workmanship within the applicable warranty period set forth herein, Retractableawnings.com will repair or replace, at Retractableawnings.com’s option any defective part. Retractableawnings.com’s obligation is exclusive of labor and shipping costs. In no event shall customer be entitled to consequential, indirect or special damages of any nature for defective merchandise and in no instances may damages include loss of profit. Retractableawnings.com reserves the right to issue a cash refund to the customer in an amount equal to the cost of repair or replacement of any defective part in lieu of any obligation to provide a replacement.

Retractableawnings.com reserves the right to inspect the system involved in any claim against the warranty. The warranty is null and void if any of the components are changed and are not original Retractableawnings.com parts.

All claims under this warranty must be made in writing to Retractableawnings.com at 4724 N.W. 165 Street, Hialeah, Florida, 33014-6423, United States of America within 30 days of the system becoming unserviceable and must be accompanied by a copy of the original order/invoice. Failure to follow this procedure voids the warranty.

The foregoing is the sole and exclusive warranty for our systems and is in lieu of all other warranties expressed or implied. The warranty cannot be transferred or assigned by the customer. All disputes arising from this warranty are to be governed by the laws of the State of Florida and any action to enforce this warranty must be initiated in the State of Florida.

Some states do not allow the exclusion or limitations of incidental or consequential damages or limitations on how long an implied warranty lasts, so the above limitation or exclusion may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
 

 

TENARA SEWING THREAD WARRANTY

W.L. Gore & Associates guarantees that its Tenara sewing thread will be free from defects in material and workmanship and will not be damaged by exposure to sunlight, weather, or water for as long as the fabric manufacturer warrants the fabric on which it is used, up to a maximum of eight (8) years. This warranty covers all residential and commercial retractable awning applications. This warranty does not cover damages from fires, and cuts. All other express warranties are disclaimed. This warranty extends only to the original owner of the retractable awning on which Tenara sewing thread is used.

W.L. Gore & Associates will replace any Tenara sewing thread which does not meet this warranty, or, at Retractableawnings.com’s option give you a full refund for the thread. In addition, Gore will pay Retractableawnings.com for the reasonable and customary expense of restitching any awning which was entirely stitched with Tenara sewing thread. This warranty does not cover costs incurred in the removal, transportation, or reinstallation of any retractable awning or any other incidental costs. This warranty gives you specific legal rights; you may also have other legal rights which may vary from state to state. W.L. Gore is not responsible for incidental or consequential damages. Some states do not allow limitations or exclusion of incidental or consequential damages so this exclusion may not apply to you. Contact Retractableawnings.com to make a claim under this warranty.
 

SUNBRELLA AWNING FABRIC WARRANTY

The warranty covers the fabric becoming unserviceable because of loss of color or strength from normal exposure conditions, including sunlight, mildew, rot or atmospheric chemicals. It does not cover labor and installation or removal of the awning.

The warranty period runs for 5 years from the date of the original order.

Sunbrella will supply new fabric free to replace the fabric which becomes unserviceable. Contact Retractableawnings.com for the replacement fabric.

This warranty gives you specific legal rights and you may have other rights which vary from state to state.
 

DICKSON (DICKLON 32) FABRIC WARRANTY

Dicklon 32, which is a 100% solution dyed acrylic fabric is warranted for 5 years against rot, mildew and variations of dimensional stability and color under the following conditions:

· The fabric must be properly installed, utilized and maintained. The warranty does not apply against deteriorations of any kind due to abusive use, malfunction, negligence, vandalism, accidental burns, perforations and acts of God.

· Dimensional stability is guaranteed to remain and plus or minus one percent or less in applications under proper installation and careful use.

· While all color pigmentations fade eventually, the Diklon 32 color fastness is guaranteed to remain within the standards set under normal conditions of exposure and atmospheric chemical pollution.

· Normal wear, weather soiling, or stains from environmental pollution or other sources are not covered.

· The warranty, if applicable, is limited to the replacement of fabric free of charge. ¨Frames, systems or labor are not covered by this warranty.

· Dickson makes no warranty of fitness for any particular purpose whatsoever with respect to the goods being sold.

· There are no warranties, express or implied, which extend beyond the description on the face of this agreement.

· The warranty is valid for 5 years from original order date providing the warranty card attached with each order is filled out and returned within 30 days or receipt of the retractable awning.
 

GOTTSCHALK PLANASOL ACRYLIC FABRIC WARRANTY

Gottschalk Planasol acrylic retractable awning fabrics made from spun-dyed acrylic fibers are guaranteed by G+M SunTextil GmbH (Gottschalk) for 5 years from the date of the order. The guarantee covers any abnormal deterioration in strength or color that makes the fabric unsuitable for sun protection. The guarantee is subject to the following qualifications:

· The valance and seams are not covered by Gottschalk.

· The retractable awning must be properly installed and maintained. Damage caused by incorrect installation or maintenance e.g. cleaning with unsuitable products is not covered. Planasol fabrics should be washed occasionally with warm water containing a mild detergent.

· Normal wear and tear e.g. weather soling, stains from external sources including air pollution are not covered.

· Burns or perforations are not covered.

· Accidents, abuse and negligence are not covered.

· Gottschalk will supply new fabric to replace the defective fabric. If the particular style is no longer available, the nearest substitute will be supplied.

· Gottschalk reserves the right to decide whether to replace the complete retractable awning cover or only the affected part.

· Gottschalk is not liable for the cost of dismantling the old retractable awning and installing the new fabric.

· Gottschalk is not liable for any consequential loss.

Claims under this guarantee should be made in writing either to G+M SunTextil GmbH (Gottschalk) or through Retractableawnings.com.
 

MOTOR WARRANTY

Retractableawnings.com warrants that the retractable awning motors will be free of defects in material and workmanship under normal and proper storage and usage, and maintenance for a period of 5 years starting from the date of manufacture. Retractableawnings.com upon notification and substantiation thereof along with presentation of proof or purchase, will correct the nonconformity by repair or replacement FOB Miami, Florida. The sole remedy of the buyer with respect to such defects shall be the repair or replacement of such item by Retractableawnings.com

This warranty does not cover costs incurred for labor on location, service call, back charges, reinstallment, or returning of the product. This warranty is void if the motor suffered abuse, acts of God, modification or alteration by unauthorized personnel.
